Build my Arizona plan →Summary
Arizona does not have a statewide license specifically for "secondhand dealers" who buy and resell goods outright — as opposed to pawnbrokers, who lend money against pledged goods. The statewide pawnbroker statute expressly excludes a "good faith outright purchase" from its definition of a "pawn transaction" (ARS 44-1621(9)), so a dealer who simply buys watches outright is not regulated as a pawnbroker under it. Instead, licensing, reporting, and holding-period rules for outright-purchase dealers are set city by city (confirmed for Phoenix, Scottsdale, and Tucson — see the city pages). Sales tax — Arizona's Transaction Privilege Tax, "TPT" — applies statewide regardless of city licensing.
Licensing and registration
Arizona's pawnbroker statute (ARS Title 44, Chapter 11, Article 3) is a statewide licensing regime, but a "pawn transaction" there excludes a good-faith outright purchase of tangible personal property (ARS 44-1621(9), confirmed on azleg.gov). A watch dealer who buys inventory outright is therefore outside it, and there is no separate statewide "secondhand dealer" license in Title 44, Chapter 11. Statewide, the only license a watch reseller needs is the TPT license for sales tax (below); the buy-side secondhand-dealer rules — licensing, reporting, holding — are set at the city level.
Definitions and exemptions
The operative statewide fact is the "outright purchase" exclusion from "pawn transaction" in ARS 44-1621. No state-level definition of "secondhand dealer," distinct from pawnbroker, was found; that term is defined at the city level (see the city pages).
Holding periods and law-enforcement reporting
ARS 44-1625 keys the daily report-to-sheriff duty to a "pawnbroker," and to a "reportable transaction" — which ARS 44-1621(15) defines as a transaction conducted by a pawnbroker. Because a good-faith outright purchase is not a pawn transaction and an outright buyer is not a "pawnbroker," these statewide reporting and holding sections do not reach a dealer who only buys and sells watches outright (both sections confirmed on azleg.gov). The reporting and holding rules that do apply are city-level (for example, Phoenix's 10-day standard hold; Tucson's up-to-90-day investigative police hold).
Records
No statewide recordkeeping mandate applicable to outright-purchase secondhand dealers was found. City-level record requirements are in the city pages (for example, Tucson requires records kept at least two years; Phoenix requires transaction reports retained on premises for six months).
Sales tax (TPT), permits, nexus, and marketplaces
A business selling tangible personal property at retail in Arizona — which includes a watch dealer's resale activity — generally needs a TPT license from the Arizona Department of Revenue; retail falls under business code 017. Arizona's economic-nexus threshold for out-of-state sellers is $100,000 in Arizona gross sales per year for 2021 and later (it was $200,000 for 2019 and $150,000 for 2020). Marketplace facilitators over $100,000 in Arizona sales must register and collect TPT on behalf of their sellers, effective October 1, 2019 — so sales made through a large marketplace are generally the marketplace's TPT responsibility, not the individual dealer's, though that depends on the platform's own registration. Resale-certificate mechanics and use-tax treatment of out-of-state purchases were not retrieved and are flagged for follow-up.
Consignment and bill of sale
No statewide consignment-specific statute for secondhand goods was located; Phoenix's ordinance does regulate consignment activity by secondhand dealers (see the Phoenix page). Flagged for a fuller search of Title 44's commercial provisions.
Business registration
A business operating under a name other than the owner's legal name can file that trade name with the Arizona Secretary of State, which lasts five years from the date of receipt. Note what the Secretary of State says about it: a trade name "is not legally required but is an acceptable business practice," and it grants no exclusive rights to the name. Filing is online only, and the office publishes no base filing fee on its trade name page. Entity formation (LLC or corporation) is handled by the Arizona Corporation Commission; LLC Articles of Organization are $50 (an optional $35 buys expedited processing).
Watch-specific oddities
No Arizona statute or rule naming watches specifically was found at the state level in this pass.
How to get compliant
- 1
Register the business entity with the Arizona Corporation Commission (LLC Articles of Organization are $50, or $85 expedited). If you trade under a name other than your own, consider filing a trade name with the Arizona Secretary of State — it lasts five years from the date of receipt, but the Secretary of State states plainly that it is not legally required.
- 2
Obtain a Transaction Privilege Tax (TPT) license from the Arizona Department of Revenue before making taxable retail sales.
- 3
Check, city by city, whether a local secondhand-dealer license is required — confirmed required in Phoenix, Scottsdale, and Tucson (see the city pages).
- 4
Complete any fingerprinting or background check tied to the local license.
- 5
Set up the transaction-reporting and holding-period procedures your city requires.
- 6
Does this apply to you?
Some of these rules turn on how you actually operate. Answer a question and we’ll show what the rule says for that answer — with the citation. This is general information, not a legal determination about your business.
How do you take watches in?
Arizona's statewide licensing and report-to-sheriff rules live in the pawnbroker statute, and a "pawn transaction" turns on a redeem/repurchase agreement.

(3) LOAN means advancing money on the security of pledged goods OR PURCHASING TANGIBLE PERSONAL PROPERTY ON THE CONDITION THAT IT MAY BE REDEEMED OR REPURCHASED BY THE SELLER for a fixed or variable price within a fixed or variable period of time. (9) PAWN TRANSACTION means either the act between the pawnbroker and a person pledging tangible personal property or extending credit on the security of pledged goods OR the act of purchasing tangible personal property with an express or implied agreement or understanding that it may be redeemed or repurchased by the seller for a fixed or variable price within a fixed or variable period of time; EXCEPT THAT A GOOD FAITH OUTRIGHT PURCHASE OF TANGIBLE PERSONAL PROPERTY IS NOT A PAWN TRANSACTION. (10) PAWNBROKER means a person who is engaged in the business of advancing money on the security of pledged goods or is engaged in the business of purchasing tangible personal property on the condition that it may be redeemed or repurchased by the seller. (2) IDENTIFICATION DOCUMENT means a valid driver license; a valid nonoperating identification license; a valid armed forces identification card or any other valid government issued photo identification. (4) LOCAL LAW ENFORCEMENT AGENCY means the chief of police; the police department or the town marshal if applicable to a city or town; or the county sheriff; the sheriff's designee or the county sheriff's department if applicable to a county. The exception in paragraph (9) is the provision on which Arizona's whole city-by-city structure rests: a dealer who buys outright with no right of repurchase is outside the pawnbroker article; and therefore outside the statewide licensing and reporting duties that run on pawnbrokers — retrieved 2026-09-23 · 2026 ARS (57th Leg 2nd Reg Sess)

- Arizona Department of Revenue - Transaction Privilege Tax (TPT) License. A business selling a product or engaging in a taxable activity in Arizona must obtain a TPT licence from the Department of Revenue before making taxable retail sales; the licence is also the vehicle for reporting and remitting city privilege tax. THE COST FOR EACH LICENCE PER LOCATION IS $12.00; and where ownership is the same; locations can be consolidated under one licence number so the taxpayer files a single return. For special events the STATE LICENCE FEE REMAINS $12 no matter how many special events a vendor attends; but A SEPARATE CITY LICENCE FEE IS REQUIRED for each city in which the vendor operates. Licences are not delivered until all licence and renewal fees are paid in full; and certificates cannot be printed online. The TPT licence number is eight digits — retrieved 2026-09-23
- Arizona Department of Revenue - Economic Threshold (out-of-state sellers). House Bill 2757 introduced an economic; dollar-based nexus standard for businesses with NO PHYSICAL PRESENCE in Arizona. Economic nexus is established if the thresholds were met IN THE PREVIOUS CALENDAR YEAR OR ARE MET IN THE CURRENT YEAR. FOR A MARKETPLACE FACILITATOR: Arizona gross sales (before any deductions) of MORE THAN $100;000. FOR A REMOTE SELLER: Arizona gross sales (before any deductions) of $200;000 in 2019; $150;000 in 2020; and $100;000 IN 2021 AND BEYOND. Things to note: SALES MADE BY REMOTE SELLERS OR MARKETPLACE SELLERS THROUGH A MARKETPLACE FACILITATOR ARE NOT INCLUDED IN THE REMOTE SELLER'S THRESHOLD CALCULATION; and Arizona TPT due on those sales is reported and remitted BY THE MARKETPLACE FACILITATOR. Sales made by a remote seller DIRECTLY into Arizona (not through a marketplace) are reported by the remote seller; who must be licensed and collect once the threshold is met. Thresholds are calculated INCLUDING any income generated by an AFFILIATED PARTY; meaning a person or company with more than 5 percent ownership in the other party or related through a third person or group holding an ownership interest — retrieved 2026-09-23 · 2021-and-later threshold in effect
- Arizona Department of Revenue - Frequently Asked Questions; Out-of-State Sellers (remote sellers and marketplace facilitators). Supports the Arizona guide's statement that marketplace facilitators over the threshold register and collect TPT on behalf of their sellers; so sales made THROUGH a large marketplace are generally the marketplace's TPT responsibility rather than the individual dealer's. The operative thresholds and the affiliated-party rule are quoted in full at AZ4; which is the Department's dedicated Economic Threshold page. - Arizona Secretary of State - Trade Names and Trademarks. Filing a trade name registers a business name for public record. A TRADE NAME IS SIMILAR TO A DOING BUSINESS AS (DBA) NAME; AND IS NOT LEGALLY REQUIRED BUT IS AN ACCEPTABLE BUSINESS PRACTICE. A trade name DOES NOT GRANT EXCLUSIVE RIGHTS to a business name; nor is it similar to a corporation or LLC - to file a corporation or LLC you file with the ARIZONA CORPORATION COMMISSION instead. These filings are ONLY APPLICABLE IN ARIZONA and are not substitutes for national filings. FILING LENGTH: TRADE NAMES LAST FOR 5 YEARS FROM THE DATE OF RECEIPT; trademarks last for 10 years. Online filing has been fully implemented and PDF FORMS ARE NO LONGER ACCEPTED. Other stated charges: a $25.00 fee if an account returns insufficient funds; a DUPLICATE CERTIFICATE IS $3; plain copies of applications on file are 10 cents per page with $3 extra per request for certified copies. NOTE ON RE-CHECK 2026-09-23: THE BASE TRADE NAME FILING FEE IS NOT STATED ANYWHERE ON THIS PAGE.
