Newark has no secondhand-dealer chapter as such. The licence that catches a watch dealer is ch. 8:23, Precious Metals and Gems, rewritten in 2019, and its definitions go far beyond metal — down to an appendix that closes with "any and all items of value". The statewide rules are in the New Jersey guide.

Who needs the licence

The licence comes from the Public Safety Director, one per location, and the application carries a photograph and full fingerprints of whoever runs the premises day to day. A gold, gold-plated, two-tone or silver watch puts you squarely inside the chapter, because Newark counts any gold or silver content "without regard to the fineness thereof".

A steel-only dealer is in an awkward spot. The licence section is worded around precious metals or gems, but the record, database and hold duties are worded around "secondhand goods" too. Nobody has settled whether that steel dealer needs the licence, and it is the first question to put to the city.

The fee is not in the code. Ch. 8:23 refers to fees "previously established" without stating one, and none appears in the consolidated fee table or on the Division's page. Ask the Division of Tax Abatement and Special Taxes. Do not confuse it with the $500 Retail Licence under ch. 8:34, a separate licence a storefront will likely also need.

Noon the next business day

Every purchase from the public goes into an electronic database chosen by the Public Safety Director by noon the next business day, with a colour image of every item and of the seller's ID. The code names no vendor, so the city is the only place to find out which system it is. The system costs you up to $300 per year. You keep a bound, numbered book in ink as well — the database does not replace it.

Seven business days

Everything bought from the public is held at least seven business days from purchase, which in practice is a week and a half. If the state's used-jewelry rule reaches watches, its own longer period runs alongside and Newark's does not shorten it.

Cash

No more than two cash payments to the same seller in any 7 days, and none at all to a seller who makes more than five transactions in 30 days. Past those limits the payment goes by bank check from the business account.

Exemptions worth knowing

  • Dealer-to-dealer buying from wholesalers or other legitimate suppliers is outside the chapter, though you keep those records six months. A purchase from a retail jeweler is the grey case.
  • Antique dealers as the chapter defines them are exempt, which may help a true vintage-only dealer. Untested.
  • Clothing under $1,000, defined to include "fashion accessories", is exempt. Whether a watch is a fashion accessory is arguable either way.

Newark is on the state's Urban Enterprise Zone list; what that does to the sales tax on in-person sales is covered on the New Jersey page.

Official name
Precious Metals and Gems licence (Newark Revised Ordinances ch. 8:23), issued by the Public Safety Director
Who it applies to
No one may carry on the business of purchasing precious metals or gems in Newark without this licence, and each location needs its own (§§ 8:23-2, 8:23-3). "Gold" and "silver" mean any article with gold or silver content regardless of fineness, so gold-plated and two-tone watches are in. A "dealer" is anyone who buys, transfers or takes on consignment those articles, jewelry or secondhand goods, and includes anyone advertising or soliciting their purchase or sale (§ 8:23-1) — an online "we buy watches" listing aimed at Newark sellers likely counts. Whether a dealer buying only steel watches needs the licence is not settled: the licence section speaks of "precious metals or gems", while the record, database and hold duties also cover "secondhand goods". The chapter does not apply to purchases from wholesalers or other legitimate suppliers, or to antique dealers as it defines them (§ 8:23-14). Ch. 8:23 is the only Newark chapter that reaches a used-watch dealer; there is no general secondhand-dealer chapter.
Reporting system
Electronic database designated by the Newark Public Safety Director (the ordinance names no system or vendor)
What must be reported
Each purchase, pawn or consignment intake from the public goes on a numbered receipt and into the database: the seller's name, address, date of birth, phone and ID number; a full description including serial numbers; price and payment method; the seller's signature; a colour image of the seller's ID; and a colour image of every item (§ 8:23-8). The dealer pays for the system, not to exceed $300 per year. A bound record book with sequentially numbered pages, written in ink, is kept as well and stays on the premises open to police inspection without notice (§ 8:23-7).
Reporting cadence
Every transaction entered into the database by noon the next business day after the purchase or intake (§ 8:23-8).
Holding period
7 business daysAll precious metals, gems and secondhand goods purchased, for not less than seven business days from the time of purchase (§ 8:23-7(c)). Police may seize an article on reasonable suspicion and give a receipt for it (§ 8:23-10). If watches are "jewelry" under the state's used-jewelry statute, its longer hold, counted from a later start, still applies; Newark's period does not shorten it.
Fingerprinting
YesThe application includes a photograph and a complete set of fingerprints of each individual running the business day to day at the licensed premises (§ 8:23-5(b)). No licence is issued to anyone convicted of receiving stolen property (§ 8:23-11). The fingerprinting fee was not found.
Zoning / home office
Not researched. The licence is issued for the premises it names, one per location (§ 8:23-3); check Newark's zoning code separately before running the business from home or by appointment.A storefront likely also needs Newark's separate Retail Licence (ch. 8:34), which covers establishments selling merchandise "such as clothing, footwear, accessories": $500 biennial, expiring March 31, refunded less $30 if the licence is not granted. Its application requires a New Jersey Business Registration Certificate (§ 8:36-3).
Fees
Not confirmed — check with the cityRenewal: Biennial — Precious Metals and Gems licences expire on April 30 every second year (§ 8:23-4(b)). Database fee up to $300 per year on top (§ 8:23-8).Source reviewed: 2026-10-03 (Newark R.O. ch. 8:23 as replaced by Ord. 6PSF-A, 4-17-2019; no licence fee is stated in the chapter, the ch. 8:36 fee table, or the Division's page)

Does this apply to you?

Some of these rules turn on how you actually operate. Answer a question and we’ll show what the rule says for that answer — with the citation. This is general information, not a legal determination about your business.

Do the watches you buy contain any gold or silver?

Newark's "gold" and "silver" have no fineness floor: any article with gold or silver content counts.

Who do you buy from?

Do you pay sellers in cash?

Newark caps cash payments per seller (§ 8:23-9). Beyond the caps, pay by bank check drawn on the business account.

Things to confirm

Confidence: Likely

Open items a professional should verify before you rely on this page.

  • Does a dealer buying only steel watches need the ch. 8:23 licence, given that § 8:23-2 is worded 'purchasing precious metals or gems' while the duties reach 'secondhand goods'?
  • What is the Precious Metals and Gems licence fee? The chapter refers to 'fees previously established' without stating one — ask the Division of Tax Abatement and Special Taxes.
  • Which electronic database has the Public Safety Director designated under § 8:23-8?
  • Is a purchase from a retail jeweler exempt as one from a 'legitimate supplier', given that the chapter's 'public' includes retail sellers?
  • How do Newark's seven-business-day hold and the state's used-jewelry hold combine for a watch, if a watch is 'jewelry'?
  • Does the § 8:23-14 exemption for clothing valued under $1,000, which includes 'fashion accessories', reach a watch?
