Cleveland licenses secondhand dealers. What it does not do is add a holding period or a police report — the city repealed the first, and its code does not impose the second on secondhand dealers.

One fee, one fixed year

The licence is $125 a year (§ 676.07). Every licence is issued as of October 1 and expires on September 30, so a licence taken out in, say, August runs only until the end of September. Whether the fee is prorated for a part year was not confirmed.

Applying means a notarized form, a copy of your driver's license or state ID, your social security number and Federal ID number, a disclosure of any felony history, your daily hours, a description of the goods you deal in, and the Certificate of Occupancy for the business address.

Dealing without a licence is not treated lightly: any business found in violation of the licensing requirement "shall be ordered closed immediately" (§ 676.15). Under § 676.99 a first offence is a fourth-degree misdemeanour, rising to third-degree and then first-degree for later offences, and each day counts as a separate offence.

The record book

Section 676.08 copies the state secondhand-article record rule almost word for word: a separate book or electronic file, written in English when you buy, with a copy of the seller's personal identification card, entries numbered from one, and everything kept for at least one year after the purchase. Swiping the ID's magnetic strip can stand in for the copy (§ 676.062).

No city hold, no city report

The secondhand dealer's minimum holding period in § 676.10 was repealed in 2011. Chapter 676 has no routine report to police for secondhand dealers; its electronic-reporting section is for scrap metal dealers. Records are open to any law enforcement officer at reasonable times.

For a gold-watch dealer, that is not the end of it. The state precious-metals holds and daily report still apply, and Cleveland's police form or system for that report was not found — ask the Division of Police before your first purchase.

The state licence, enforced by the city

Chapter 681A says: "No person shall act as a precious metals dealer unless that person has a current, valid license issued under RC Chapter 4727 or 4728, when required to be licensed under those chapters." Breaking it is a first-degree misdemeanour under city law, unless it is a felony under the state statute. The city charges nothing extra for precious metals — the licence and its fee are the state's.

Sales tax in Cleveland

Cuyahoga County's rate in the Department of Taxation's table for October 1 – December 31, 2026 is 8.00%.

Official name
Secondhand Dealer's License (Cleveland Codified Ordinances Ch. 676), issued by the Division of Assessments and Licenses
Who it applies to
Cleveland defines a "secondhand dealer" in the state's own words: a person other than a scrap metal dealer "that purchases, sells, exchanges, or receives secondhand articles of any kind" (§ 676.01(a)(8)). The city's instruction sheet says the licence is required for exactly that activity, and treats a secondhand article as any item of personal property previously sold at retail, previously used, or not in new condition. The exclusions are trade-ins accepted against new merchandise, and businesses dealing exclusively in secondhand pianos, books and magazines, rugs and tapestries, paintings, drawings and engravings, heavy industrial equipment, furniture, or secondhand automobiles. Watches are not excluded. One drafting gap: § 676.02, the posted "License Required" section, names only junk dealers and scrap metal processors. The duty to hold the secondhand licence is evidenced by the § 676.07 fee, the revocation and closure powers, and the city's form — so the city plainly treats it as required, though which section imposes it is only likely, not confirmed.
Reporting system
No city police-reporting duty for secondhand dealers
What must be reported
Chapter 676 requires the record book to be available for inspection by any law enforcement officer at all reasonable times (§ 676.08), but sets no routine report to police for secondhand dealers. The electronic-submission section, § 676.064, applies to scrap metal dealers only. A dealer may swipe the magnetic strip on a seller's ID to record their name, address and photograph instead of making a copy (§ 676.062). For precious-metal watches the state daily report to the local police chief still applies; the form or system the Cleveland Division of Police prescribes for it was not found.

Holding period

Fingerprinting
NoNo fingerprinting appears in Chapter 676 or on the application. The application must be notarized, and asks for a copy of a state driver's license or ID, the applicant's social security number and Federal ID number, felony-history disclosure, daily hours of operation, and a description of the goods dealt in.
Zoning / home office
A copy of the Certificate of Occupancy for the business address is a condition of the licence. The form adds: "This requirement does not apply to transient or temporary event-based transactions." Cleveland's Land Use Code was not researched, so how a home-based dealer obtains one is not covered here. The night-buying ban in § 676.05 is drafted for junk dealers and scrap processors, not secondhand dealers. A secondhand dealer buying steel watches is reached by the state ban on night buying (ORC 4737.03) instead.

What is your stock made of?

Cleveland adds no precious-metals licence of its own. Chapter 681A makes it a city offence to act as a precious metals dealer without a current state licence where state law requires one.

Things to confirm

Confidence: Confirmed

Open items a professional should verify before you rely on this page.

  • Which ordinance section imposes the secondhand licence duty, given that § 676.02 as posted names only junk dealers and scrap metal processors?
  • Does the $125 secondhand licence reach a dealer whose stock is entirely gold or platinum watches, when ORC 4737.011 removes precious-metal purchases from the state provisions that § 676.08 copies, but § 676.01(a)(8) covers 'secondhand articles of any kind'?
  • Does an online or appointment-only dealer with no retail premises need the Certificate of Occupancy, or does the carve-out for 'transient or temporary event-based transactions' cover them?
