Summary

Unincorporated Clark County is a different jurisdiction from the city of Las Vegas, and in most respects a stricter one. That matters more here than in most metros, because a great deal of what people call "Las Vegas" — Paradise, Winchester, Enterprise, Spring Valley, and most of the Strip corridor — is county, not city.

Four things set the county apart:

  • Its definition of a secondhand dealer has no antiques or collectibles carve-out.
  • The licence is granted by petition to the Board of County Commissioners, not over a counter.
  • The bond is $1,000 with two or more individual sureties — a stated figure, where the city states none.
  • You cannot operate on Las Vegas Boulevard south of the city at all.

The state duties in the Nevada guide apply on top of all of this.

The carve-out that isn't here

This is the most important difference, and it cuts against the main argument a Nevada watch dealer has.

NRS 647.018 excludes "antiques, used books, coins and collectibles" from the definition of a secondhand dealer, and LVMC 6.74.020 repeats that exclusion. Whether watches are collectibles is an open question at state level.

Clark County Code 6.28.020 contains no such exclusion. It defines a secondhand dealer as anyone other than a licensed pawnbroker with a place of business in the unincorporated county, for "purchasing, trading or dealing in any secondhand article whatsoever."

Its exemptions are a closed list, and none of them reaches a watch dealer:

  • same-kind trade-ins by a licensed business
  • coins, gold or silver which are not part of any jewelry — a bullion and coin exemption, not a watch one
  • garage sales on the owner's property, no more than four days per calendar half-year
  • used books, newspapers and periodicals
  • used video games, tapes, discs and recordings traded for credit by a licensed retailer

So a dealer who might argue their way out of NRS Chapter 647 on the collectibles point still needs the county licence. Do not carry the state argument across the jurisdictional line.

Getting licensed is a public process

The county does not issue this licence at a counter.

All applications and renewals are made by petition to the Board of County Commissioners at a regular meeting. The petition is referred immediately to the director of business license, who returns it with findings to the Board for final action at the next regular meeting (CC 6.28.080). Plan around the Board's calendar, not a processing queue.

Fingerprints go to the sheriff. You must list every previous arrest, conviction and pending litigation except minor traffic citations, certify that list true and complete, then present yourself to the sheriff for fingerprinting and any other identifying information needed to investigate your reputation, character and record. If the applicant is a corporation, every principal officer must present themselves at the sheriff's office, and all stockholders must be named (CC 6.28.050).

The bond is $1,000, running to the county, conditioned on faithful observance of the chapter, with two or more individual sureties (CC 6.28.090). Unlike the city of Las Vegas, the figure is in the ordinance.

The investigation fee is uncapped at the bottom. You pay the county's actual cost, never less than $150 per applicant, non-refundable, paid at application as a deposit toward that actual cost (CC 6.28.040). The licence fee itself is refundable if the licence is not granted; the investigation fee is not.

And the application asks for something unusual: the amount of capital you propose to use in the business (CC 6.28.040(b)), which is then printed on the licence itself (CC 6.28.110).

Note who cannot hold one. The county declares unqualified anyone without a reputation for good moral character, anyone under twenty-one, anyone convicted of a crime involving moral turpitude, and anyone the Board determines unsuitable (CC 6.28.010).

The fee, and a class question that inverts the city's

Fees are semiannual, set by the kind of article dealt in (CC 6.28.160):

  • Class I — secondhand vehicles, trailers, used parts, accessories or salvage — $200 per half-year
  • Class II — anyone dealing in any secondhand articles except Classes I and III — $175 per half-year
  • Class III — a specialty shop dealing in only one used commodity — $100 per half-year
  • Class IV — used motor vehicle lots — computed under CC 6.12.835

A dealer trading only used watches has a real argument for Class III, on the basis that watches are a single used commodity. Add jewellery or anything else and you are in Class II.

Watch the trap. Clark County's Class III is not the same idea as Las Vegas's Class III. In the city, Class III means dealing exclusively in precious metals and gemstone articles. In the county, it means a single-commodity specialty shop. A dealer who reads across from one code to the other will get the fee and the category wrong. The classification is the Department's determination either way.

Charitable organisations are exempt from both the fee and the background investigation (CC 6.28.165).

Where you may not trade

Las Vegas Boulevard is closed to this business. CC 7.16.030 prohibits any licensed secondhand dealing business or secondhand shop from being conducted, maintained or operated on Las Vegas Boulevard south of the city of Las Vegas, or on any intersecting highway, street or road within 1,000 feet of its intersection with the Boulevard.

That is a flat geographic bar on the most commercially obvious address in the county. Check any prospective premises against it before you sign anything.

Three further location rules:

  • Nothing off-site. No secondhand dealer may use any property, private or public, outside the licensed premises for the storage, handling or display of any secondhand article (CC 7.16.110). On its face that reaches off-site vaulting, which is worth raising with an attorney if that is how you hold stock.
  • One licence per location (CC 6.28.030), and the licence only entitles you to trade at the place named on it (CC 6.28.110).
  • Nothing else from the same licence. The licence does not permit you to conduct any other business except the sale of secondhand articles (CC 6.28.120), and you may not simultaneously hold a junk shop licence (CC 7.16.170).

The sign is not optional. At all times, in a conspicuous place at the public entrance, in letters not less than six inches high: your name and the words "secondhand dealer" (CC 6.28.170). You must also post the licence certificate and a copy of all the chapter's provisions inside (CC 6.28.150). And every advertisement must carry your county business licence number (CC 7.16.205).

Daily reports, on the sheriff's paper

Every secondhand dealer in the unincorporated county must, before twelve noon each day, mail in duplicate to the sheriff a full, true and correct transcript of all the previous day's transactions (CC 7.16.060).

Two details the state statute does not have. The sheriff authorises the format of the report blanks (CC 7.16.070), and sells them at cost to the dealers required to file (CC 7.16.080). So ask the sheriff's office what form they want before your first purchase.

Anything you have good cause to believe was lost or stolen goes to the sheriff forthwith.

Note the wording says mail, where NRS 647.120 allows any means the recipient directs, including electronic. If you intend to file electronically, confirm it with the sheriff rather than assuming the state's flexibility overrides the county's text.

The hold, and a second one for taking a watch apart

Thirty days. All individually identifiable goods must be kept without concealment, open to inspection by LVMPD or business licensing agents, for thirty days before being sold, shipped or otherwise disposed of (CC 7.16.100). That runs alongside the state's 30-day period under NRS 647.130, which applies in Clark County because the county's population is over 700,000.

And a separate two-day hold before you take a watch apart. CC 7.16.130 is specific:

No secondhand dealer shall take apart or melt up any watch, watchcase or article composed or manufactured in whole or in part of gold, silver or platinum … until he shall have made a record of his intention to do so … and shall have reported the same to the sheriff … and unless and until he shall have kept such article intact in his licensed place of business for inspection for two days after the report has been delivered.

So parting out a watch, or scrapping a gold case, is a reportable event in its own right — recorded in the book, reported to the sheriff the same way a purchase is, then held intact for two days unless the sheriff inspects and clears it sooner.

Whether that reaches routine servicing that opens a case is not obvious from the text, and is flagged for an attorney.

Records and receipts

The county re-enacts NRS 647.110 in its own code at CC 7.16.050, rather than merely cross-referencing it as the city does. That includes the clause dictating how a watch must be described — maker, plus the movement or case number — which is set out in full in the Nevada guide. Writing it into the county code matters practically: a county licensing agent can enforce it directly, without reaching for the state statute.

The record and all goods received must be open to inspection by the district attorney or any peace officer during ordinary business hours.

Two receipt obligations sit on top:

  • A printed receipt to the seller showing the amount paid, a description of the property, the date and the purchaser's name — and you must affix an identifiable mark to each article so it can be checked (CC 7.16.040).
  • A signed receipt containing the substance of the record-book entry and the sum paid, delivered at the time of each purchase, with no charge for it (CC 7.16.200).

You are also liable for everything your employees do under the chapter (CC 7.16.180).

What this guide does not cover

Zoning and land-use approval beyond the Boulevard prohibition, the mechanics of the Board petition, and Clark County's own business licence application forms were not retrieved for this edition.

Henderson and North Las Vegas are separate incorporated cities with their own codes, neither researched yet. If your premises are in either, the county chapters do not apply to you — but NRS Chapter 647 still does.

Permit required
Yes
Official name
Secondhand dealer's license (Clark County Code Ch. 6.28)
Who it applies to
Clark County Code 6.28.020 defines a secondhand dealer as any person, firm or corporation other than a licensed pawnbroker with a place of business in the county outside the incorporated cities and towns, for purchasing, trading or dealing in "any secondhand article whatsoever." Unlike NRS 647.018 and LVMC 6.74.020, this definition contains no exclusion for antiques or collectibles. The listed exemptions — same-kind trade-ins, coins and bullion not part of jewelry, occasional garage sales, used books and periodicals, and credit-only media trade-ins — do not reach a watch dealer. A separate licence is required for each location.
Reporting system
Daily transcript to the Clark County Sheriff, on blanks the sheriff authorises
What must be reported
A full, true and correct transcript of the record of all transactions had on the preceding day. The sheriff authorises the format of the report blanks and sells them at cost.
Reporting cadence
Daily, before twelve noon, mailed in duplicate to the sheriff of the county (CC 7.16.060). Property believed lost or stolen must be reported forthwith. This is the county's own requirement, sitting alongside the state duty in NRS 647.120.
Holding period
30 daysAll individually identifiable goods, wares and merchandise must be kept without concealment for 30 days, open to inspection by LVMPD or business licensing agents, before being sold, shipped or otherwise disposed of (CC 7.16.100). Furniture and carpets are three days; non-running vehicles two. Separately, taking apart or melting any watch or watchcase requires a recorded and reported intention and a further two-day inspection hold (CC 7.16.130).
Fingerprinting
YesThe applicant must list all previous arrests, convictions and pending litigation except minor traffic citations, certify them true and complete, and present himself to the sheriff, who fingerprints the applicant and takes other identifying information in order to investigate reputation, character and record (CC 6.28.050(d)). Where the applicant is a corporation, all principal officers must present themselves at the sheriff's office for fingerprinting, and all stockholders must be named (CC 6.28.050(b)).
Zoning / home office
CC 7.16.110 bars a secondhand dealer from using any property, private or public, outside the licensed premises for the storage, handling or display of any secondhand article — so off-site storage, a home safe or a third-party vault is a problem unless it is within the licensed premises. The licence itself is tied to the place of business named on it (CC 6.28.110).No licensed secondhand dealing business may be conducted on Las Vegas Boulevard south of the city of Las Vegas, or within 1,000 feet of the intersection of Las Vegas Boulevard and any intersecting highway, street or road (CC 7.16.030).
Fees
Semiannual licence fee by class (CC 6.28.160): Class I (vehicles, parts, salvage) $200; Class II (any secondhand articles other than Classes I and III) $175; Class III (a specialty shop dealing in only one used commodity) $100. Plus a non-refundable investigation fee equal to the county's actual cost, minimum $150 per applicant (CC 6.28.040), and a $1,000 bond with two or more individual sureties (CC 6.28.090)Renewal: Semiannual, payable on the semiannual cycle billing date. No licence may be renewed or extended beyond a total of one year without complying with all provisions of the chapter (CC 6.28.140), and renewals go back to the Board by petition (CC 6.28.080)Source reviewed: 2026-09-23 (Clark County Code Ch. 6.28 and Ch. 7.16, current online version)

Is your place of business inside a city, or in unincorporated county?

This chapter applies only outside the incorporated cities and towns. Much of what people call Las Vegas — including most of the Strip corridor — is unincorporated Clark County, not the city.

Do you deal in watches and nothing else?

Clark County sets its fee by class, and Class III is defined as a specialty shop dealing in "only one used commodity."

Where will the licensed premises be?

The county bans licensed secondhand dealing from a specific corridor.

Where do you keep inventory that isn't on display?

Things to confirm

Confidence: Confirmed

Open items a professional should verify before you rely on this page.

  • Confirm whether a dealer trading only in watches is a Class III specialty shop at $100 per half-year, or a Class II dealer at $175, since the code turns on dealing in 'only one used commodity'.
  • Confirm how CC 7.16.110 (no storage, handling or display outside the licensed premises) applies to inventory held in a bank vault, a safe deposit box or a third-party vaulting service.
  • Confirm whether the county reads its own definition, which has no antiques or collectibles exemption, as reaching vintage watches that might fall outside NRS 647.018.
  • Confirm whether CC 7.16.130 (record of intention to dismantle) applies to routine servicing that opens a watch case, or only to breaking up and melting.
